1. Acceptance of Terms

These Terms form a binding agreement between you and Hajj Media. They incorporate our Privacy Policy. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility

You must be at least 18 years old, or have the involvement and consent of a parent or guardian, to use the Services. Where a program we operate involves minors (such as a youth workforce pilot), participation is arranged through the operating partner organization with appropriate parental or guardian consent.

3. Our Services

Hajj Media is a development and consulting organization. Our work includes, without limitation:

• Software & product development and consulting for brands, nonprofits, and DAOs.
• Civic technology, including the Learn & Earn youth workforce and attendance pilot and related notification services.
• AI-native knowledge systems, such as LoreForge.
• Legal AI intake tooling (in development).
• Publishing and thought leadership, including the Faith & Cryptocurrency book and related writing.
• I.P., systems, and Web3/DAO development for partner ecosystems.

Informational content about our Services on this website is general in nature and may change. Specific paid engagements are governed by separate written agreements as described in Client & Partner Engagements.

4. SMS / Text Messaging Terms

If you are enrolled in a Hajj Media SMS program (for example, Learn & Earn program notifications), the following terms apply in addition to our Privacy Policy:

You agree to provide a mobile number that you are authorized to use, and to notify the program if your number changes or is reassigned.

5. Acceptable Use

You agree not to:

• Use the Services for any unlawful, harmful, or fraudulent purpose.
• Access, tamper with, or disrupt the Services, their security, or related systems and networks, or attempt to gain unauthorized access.
• Copy, scrape, reverse engineer, or create derivative works from the Services except as permitted by law or by us in writing.
• Misuse the SMS program, send unsolicited messages through it, or impersonate another person.
• Infringe the intellectual property or privacy rights of others.

6. Intellectual Property

The Services and their content — including text, software, designs, logos, and the "Hajj Media" name and marks — are owned by Hajj Media, LLC or its licensors and are protected by intellectual property laws. Except for rights expressly granted to you, we reserve all rights. You may not use our names, logos, or content without our prior written permission. Third-party brands referenced in our work (for example, partner or product names) belong to their respective owners.

7. Client & Partner Engagements

Consulting, development, and pilot engagements are governed by separate written agreements (such as statements of work, master service agreements, or data-processing or partner agreements) executed between you or your organization and Hajj Media. If there is a conflict between these Terms and a signed agreement covering a specific engagement, the signed agreement controls for that engagement.

8. Pilots, Demos & Beta Features

Some Services — including demos, pilots, and features identified as early, beta, or "in development" — are provided for evaluation and may be incomplete, change, or be discontinued at any time. They are provided "as is" without warranties, and should not be relied upon as production-ready unless agreed in writing.

9. Third-Party Services & Links

The Services rely on and may link to third-party services (for example, Netlify for hosting and Twilio for SMS delivery) and third-party websites (for example, UrbanGriotz/LoreForge, the Faith & Cryptocurrency site, and Substack). We do not control and are not responsible for third-party services or content, which are subject to their own terms and privacy policies.

10. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or that messages will always be delivered. Nothing on the Services constitutes legal, financial, or professional advice.

11. Limitation of Liability

To the maximum extent permitted by law, Hajj Media and its members, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business, arising out of or related to your use of (or inability to use) the Services. To the maximum extent permitted by law, our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us for the specific Service giving rise to the claim in the twelve months before the claim, or USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Hajj Media and its members, officers, employees, and contractors from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in California, unless a signed engagement agreement specifies a different forum or dispute-resolution process. If any provision of these Terms is held unenforceable, the remaining provisions remain in effect.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Services after an update means you accept the revised Terms.
